WHAT IS A CERTIFICATE OF REHABILITATION?
A Certificate of Rehabilitation is a court order that declares that a convict (a person convicted of a crime) is now rehabilitated. If you have been convicted of certain offenses including felonies, and were successful in having your conviction expunged, it may be in your best interest to speak to experienced San Diego criminal defense lawyer Timothy Riley regarding expungements and a Certificate of Rehabilitation. If a Certificate of Rehabilitation is granted, you automatically become eligible to apply for a pardon by the Governor of California. However, the pardon is not guaranteed even if you are granted a Certificate of Rehabilitation.
WHO IS ELIGIBLE AND NOT ELIGIBLE FOR A CERTIFICATE OF REHABILITATION?
In case of felonies, you must have completed all parole, post release community supervision, mandatory supervision, and must have lived in California continuously for the last five years if you were sentenced to incarceration. If sentenced to probation, you must have your case expunged before applying for a Certificate of Rehabilitation. In case of certain misdemeanors, you may also be eligible for a Certificate of Rehabilitation. You are not eligible for a Certificate of Rehabilitation under certain circumstances including but not limited to if you were convicted of certain sex offenses, currently serving in the military, live outside California.
