What is an Expungement?

An expungement is used to limit what shows up on some background checks. In California an expungement does not completely erase the conviction from your record but changes the conviction to show as a dismissal. It also does not seal the conviction from the public and the conviction remains on your record for purposes including sex offender registration and immigration.

What Does an Expungement do?

While an expungement in California does not completely erase your criminal record, an expungement may hide a conviction from certain background checks including employment application, rental applications, credit applications. In California, most employers can neither inquire about nor consider an expunged offense.

However, the government and federal agencies (such as the F.B.I. or Homeland Security) can often view all aspects of your criminal record even after expungement. Therefore, you may remain ineligible for certain government jobs

How do I Know if I am Eligible for an Expungement?

There are several types of offenses that may qualify for an expungement including offenses under the California Penal Code and California Vehicular Code. If you have successfully completed probation you are eligible for an expungement if you were convicted of a misdemeanor or certain low-level felonies (such as offenses which can be charged as either misdemeanors or felonies, known as “wobblers”).

Even in cases where you may not be eligible for an expungement, you may qualify for a Certificate of Rehabilitation.
